Subject to the terms and conditions of this warranty, capital lighting warrants that all products from capital lighting shall be free from defects in material and workmanship for one year. Capital lighting works hard to assure that our products are manufactured under strict quality specifications and controls which require high grade materials, finishes and packaging. Most products are handmade by craftsman and assembled under controlled conditions. Because of the nature of the hand-making process, some amount of surface imperfection and finish variation is expected and will not be considered as defective. Capital lighting is committed to providing high quality products in all respects and the final decision as to whether or not a product is defective will be made by capital lighting. Capital lighting will, at its sole discretion, replace or repair any of its fixtures that are defective in workmanship or materials. Such replacement, repair or credit is the sole remedy against capital lighting and is limited to one year from the invoice date. If a claim is made under this warranty and an investigation by capital lighting proves the claim valid, capital lighting will, at its sole discretion, repair or replace the defective product. Upon such a repair or replacement, the original remaining warranty period will continue in effect and be applicable to the repaired or replaced product. If the purchaser's original product is discontinued or no longer available, capital lighting may refund the original purchase price. Except as expressly provided in this warranty to the contrary, capital lighting will not be responsible for any costs incurred in the removal or reinstallation of any product nor any consequential damages arising out of or in connection with product nor any consequential damages arising out of or in connection with capital lighting will not be responsible for loss of or damage to any material which is not sold by capital lighting.
The following is made in lieu of all warranties, expressed or implied. Primax Manufacturing and Trading, Incorporated (PMT) and/or manufacturer’s only obligation shall be to replace such quantity of the products proven to be defective (during the manufacturing process) provided that such guarantees or replacement are a stated policy of the manufacturer. PMT and/or manufacturers shall not be liable for any injury, loss, or damage, direct, incidental or consequential, arising out of the use of the product. Before using any Caiman product, the user shall determine the suitability of the product for its intended use, and the user assumes all risk and liability whatsoever in connection therewith. No misuse, abuse, improper use, normal wear and tear is covered under the Limited Warranty. PMT reserve the exclusive right to determine eligibility of warranty. PMT reserves the right to replace, repair, or offer credit if deemed qualified. Defective products must be sent to PMT, freight prepaid, with RGA (Return Goods Authorization) number by calling customer service or by email.
